A peer review panel of managers and service workers from

a restaurant chain must decide whether or not a waitress has

been unfairly fired from her job.

“It felt like a knife going through me!” declared Mary Campbell, 53, after she was fired from her waitressing job at a restaurant in the Red Lobster chain. Instead of suing for what she considered unfair dismissal after 19 years of service, Campbell called for a peer review, seeking to recover her job and three weeks of lost wages.

Three weeks after the firing, a panel of employees from different Red Lobster

restaurants was reviewing the evidence and tried to determine whether the server had, in fact, been unjustly fired for allegedly stealing a guest comment card completed by a couple of customers whom she had served.

PEER REVIEW AT DARDEN INDUSTRIES

Red Lobster was owned by Darden Industries, which also owned other restaurant chains like Olive Garden, Longhorn Steakhouse, The Capital Grill, Bahama Breeze, and Seasons 52. The company has about 1,900 restaurants serving 400 million meals a year. Red Lobster, which has more than 180,000 employees, had adopted a policy of encouraging peer review of disputed employee firings and disciplinary actions several years earlier. The company’s key objectives were to limit worker lawsuits and ease workplace tensions.

Advocates of the peer review approach, which had been adopted at several other companies, believed it was a very effective way of constructively channeling the pain and anger employees felt after being fired or disciplined by their managers. By reducing the incidence of lawsuits, a company could also save on legal expenses.

A Darden spokesperson stated that the peer review program had been “tremendously successful” in keeping valuable employees from unfair dismissal. Each year, about 100 disputes ended up in peer review, with only 10 subsequently resulting in lawsuits. Red Lobster managers and many employees also credited peer review with reducing racial tensions. Ms. Campbell, who said she had received dozens of calls of support, chose peer review over a lawsuit not only because it was much cheaper, but “I also liked the idea of being judged by people who know how things work in a little restaurant”.

THE EVIDENCE

The review panel included a general manager, an assistant manager, a server, a hostess, and a bartender, who had all volunteered to review the circumstances of Mary Campbell’s firing. Each panelist had received peer review training and was receiving regular wages plus travel expenses. The instructions to the panelists were simply to do what they felt was fair.

Campbell had been fired by Jean Larimer, the general manager of the Red Lobster in Marston, where Campbell worked as a restaurant server. The reason given for the firing was that Campbell had asked the restaurant’s hostess, Eve Taunton, for the key to the guest comment box and stole a card from it. The card had been completed by a couple of guests whom Campbell had served and seemed dissatisfied with their experience at the restaurant. Subsequently, the guests learned that their comment card, which complained that their prime rib of beef was too rare and their waitress was “uncooperative”, had been removed from the box.

Jean Larimer’s Testimony

Larimer, who supervised 100 full- and part-time employees, testified that she had dismissed Campbell after one of the two customers complained angrily to her and her supervisor. “She [the guest] felt violated,” declared the manager, “because her card was taken from the box and her complaint about the food was ignored.” Larimer drew the panel’s attention to the company rule book, pointing out that Campbell had violated the policy that forbade removal of company property.

Mary Campbell’s Testimony.

Campbell testified that the female customer had requested that her prime rib be cooked “well done” and then subsequently complained that it was fatty and undercooked. The

waitress told the panel that she had politely suggested that “prime rib always has fat on it”, but arranged to have the meat cooked some more. However, the woman still seemed unhappy. She poured some steak sauce over the meat, but then pushed away her plate without eating all the food. When the customer remained displeased, Campbell offered her a free dessert. But the guests decided to leave, paid the bill, filled out the guest comment card, and dropped it in the guest comment box.

Admitting she was consumed by curiosity, Campbell asked Eve Taunton, the restaurant’s hostess, for the key to the box. After removing and reading the card, she pocketed it. Her intent, she declared, was to show the card to Ms. Larimer, who had earlier been concerned that the prime rib served at the restaurant was overcooked, not undercooked. However, she forgot about the card and later, accidentally threw it out.

Eve Taunton’s Testimony

At the time of the firing, Taunton, a 17-year-old student, was working at Red Lobster for the summer. “I didn’t think it was a big deal to give her [Campbell] the key,” she said. “A lot of people would come up to me to get it.”

THE PANEL DELIBERATES

Having heard the testimony, the members of the review panel had to decide whether Ms. Larimer had been justified in firing Ms. Campbell. The panelists’ initial reactions to the situation were split by rank, with the hourly workers supporting Campbell and the managers supporting Larimer. But then the debate began in earnest in an effort to reach consensus.

If finding your life purpose seems like an elusive undertaking, don’t panic! You are not alone. In this essay by Karen Wolff, you will find reassurance and practical support for finding and knowing your life purpose.

While it’s true some people seem to find their life purpose easier than others, it’s also true that God really does have a plan for every single person, even if it takes a while to see what it is.

Most people think finding your life purpose means doing something you truly love. It’s an area that just seems natural to you and things just seem to fall into place. But what if things aren’t so clear to you? What if you’re not sure what your gifts are? What if you haven’t discovered any particular talent that makes you think it could be your true calling in life? Or what if you’re working somewhere and you’re good at it, but you just don’t feel fulfilled? Is this all there is for you?

Don’t panic. You’re not alone. There are lots of people in the same boat. Take a look at the disciples. Now, there’s a diverse group. Before Jesus came on the scene, they were fishermen, tax collectors, farmers, etc. They must have been good at what they were doing because they were feeding their families and making a living.

But then they met Jesus, and their true calling came into focus very quickly. What the disciples didn’t know is that God wanted them to be happy—even more than they did.

And following God’s plan for their lives made them happy inside, where it really matters. What a concept, huh?

Do you suppose it could be true for you too? That God wants you to be truly happy and fulfilled even more than you do?

The next step in finding your life purpose is right in the Book. All you have to do is read it. The Bible says Jesus told his disciples they were supposed to love one another as he loved them. And he wasn’t kidding. Getting really good at this part of the process is like building the basement of your house.

You wouldn’t dream of moving forward without a rock-solid foundation. Discovering God’s purpose in your life is exactly the same. The foundation of the process means getting really good at being a Christian. Yup, that means being nice to people even when you don’t feel like it, forgiving people, and oh yes, loving the unlovable people in the world.

So, what does all that stuff have to do with what I’m supposed to be when I grow up? Everything. When you get good at being a Christian, you also get good at hearing from God. He’s able to use you. He’s able to work through you. And it’s through that process that you’ll discover your true purpose in life…

There is no better way to receive help and direction in your own life than to focus on someone else. It seems completely opposite of what the world tells you. After all, if you’re not looking out for yourself, then who will? Well—that would be God.

When you focus on someone else’s business, God will focus on yours. It means planting seeds in great soil, and then simply waiting for God to bring a harvest into your life. And in the meantime…

Working with God to find your life purpose means working as a team. When you take a step, God takes a step.

Be willing to try some things that interest you. You will know very quickly if you’ve found the right thing for you. Doors will either open or slam shut. Either way, you’ll know where you stand.

Be Patient. Wanting to know everything right this second is pretty common these days. Learning to trust that God will show you when He’s ready—now that takes patience. God isn’t going to show you every piece of the puzzle all at once. If he did, you’d get that “deer in the headlights” look, because you’d be so overwhelmed by it all. Not to mention you’d be overly tempted to come up with a backup plan “just in case” things didn’t work out.

Don’t let the people around you talk you into things. Just because it all sounds like a good idea from the world’s view doesn’t mean it’s God’s plan for you. Following God’s leading sometimes means you have to say no to many well-meaning family members or friends. It comes down to the decision to follow, no matter where it leads.

Lastly, don’t ever give up. You may not know your specific purpose today or tomorrow, but as long as you’re really great at being a Christian, and your heart is open, you will find God and he will find you.

Term paper prep activity #5. Today, you will do something new and different from the previous assignments. You will be writing a listing agreement (RLA) on behalf of your seller clients! Read and follow the instructions below. You will need this completed RLA for your term paper, “My Plan to Pass the Real Estate Exam”. Scroll down to the end for video examples!

At the end of Page 5, remember to insert your name Master Muhammad as the listing agent (this is how you get paid your commission!). Always capitalize the first letter of ALL names, first and last, even your own name.

Step 1. Download Mock Data

The mock data contains all the information you need to complete the Residential Listing Agreement form.

Step 2. Access the Online RLA form

We will be using the RLA form (Residential Listing Agreement) from the California Association of Realtors (C.A.R.). The form is accessible online, and you should be able to enter your data from any type of computer or tablet. The link takes you to my PDFfiller site.

I recommend opening both the mock data and the RLA form on your computer, side by side. Then, you can copy and paste the data into the form.

Reference the textbook from Huber, chapter 4, to complete this form. NOTE: If you have the Huber textbook for BRE-101, please reference chapter 4 in that textbook for step-by-step instructions. Use the mock data to complete the RLA form. Ensure you complete all blank fields, adding “n/a” (not applicable) to any fields that do not require a response. FOLLOW THE DIRECTIONS IN YOUR TEXTBOOK, CHAPTER 4. Note there is a listing agreement package (several forms) as we learned in class; however, for this assignment, you will only be completing the primary form (RLA). Additional Tips!

DATA. Please download BRE 100 Seller Listing Profile Data.docx Download BRE 100 Seller Listing Profile Data.docx and save to your computer. This is where you will find the data to copy and paste into the form.

NAMES. At the top of Page 1, insert both sellers’ names on item #1. Always capitalize the seller’s names.

APN. On page 1 near the top right, be sure to insert the property’s Assessor Parcel Number (APN). You will find this on the Seller Data Sheet.

LIST PRICE. On the first page, the list price should be in line with an actual house being listed for sale. The current average housing list price in the high desert is approximately $330,000. Of course, your listing can be higher or lower, but it cannot be $1,000 (for example) as that is unrealistic.

COMMISSION. Also on the first page, the compensation is on Page 1, in item # 3A. This is how much the seller will pay you, which is typically between 5% and 7% of the purchase price. This is the total commission (see below).

COOP COMMISSION. On page 1, Item # 3D(1) is how much of your commission you will pay to the buyer’s agent. It is typically half of your commission amount. You would subtract the coop commission from the total commission, and that is what you will earn as the listing agent. Make sense? You cannot share the same amount of compensation with the broker’s agent as you are receiving in Item # 3A. That will leave you with ZERO commission! A typical commission on link # 3A is between 5% to 7%. The amount you would share with the buyer’s agent would usually be half of that amount. For example, you would not want to collect 6% commission and then simultaneously pay 6% to the coop agent as that would leave you with 0%. Your total commission would need to be higher than the coop commission.

PROPERTY ADDRESS. Pages 2, 3, and 4 need the property address at the top of each page.

SELLER SIGNATURE. On Page 5, please insert the seller’s names underneath their signature lines and addresses following under.

LISTING AGENT. At the end of Page 5, remember to insert your name Master Muhammad as the listing agent (this is how you get paid your commission!). Always capitalize the first letter of ALL names, first and last, even your own name.

Step 4. Save Your Completed RLA Form to Your Computer as a PDF Document

Once you complete entering your mock data in the RLA form, save it to your computer as a PDF file. Re-name it to include your name in the document title. The completed document will be saved and submitted here as a PDF document attachment. Remember to SAVE a copy to your computer as the first part of your final paper.

Step 5. Submit Your Assignment

Click the “Submit” button in the top right corner of this assignment. Upload your PDF document file, and then click the “Submit Assignment” button again at the bottom.
